I was recently in a car accident where a Nissan truck ran into the back of another car that then ran into the back of me causing $2000 worth of damage to the rear of my infiniti. I received moderate whiplash to my neck and had to be taken to the hospital. I checked out without any broken bones and was prescribed medication. I went to see a chiropractor and he has been working on my neck for a couple days which makes it feel a better. Im 100% not at fault and the insurance company has taken care of my car repair, rental, and medical bills. They ask me How much do I think I want for this accident for pain and suffering. I believe I am entitled to at least $3500-5000 for my suffering I live in NC. I believe $5000 is a reasonable consider the circumstances. I could have lost my life, broke my neck and been paralyzed for life. Thank the lord that I received only a whiplash. The stress that I am undergoing, the constant pain in my neck is a reminder of the accident, which I feel fearful of driving. The time I spent recovering could have been spent enjoying my life. Besides getting behind in my school work, I am absent from my student organization at school which I am a key figure ( president AGC). I don't enjoy waking up with cramps and headaches nor do I like to take prescription pills, and therapy. I don't want to be compensation a insufficient amount that wont even cover pain and suffering I went though. It seems like you people are on the side of the insurance company and not the victims in this situation. Last year my girlfriend has a car crash, she was not at fault. So she didn't tell her insurance company and claimed of the other party. So she is assuming her car insurance does not know. Now the insurance company wants to total my car and what they are offering for my car /their initial proposed settlement of $3500is not nearly enough to buy another car in the same excellent, safe and reliable condition, that is not riddled with hidden problems. This presents a big problem for me as, if I cannot have my car fixed and restored to the same condition as before the crash, I would have to come up with at least $12K to $15K to buy another new safe, reliable economy car. This is an expense that was not in my plans. Also, the insurance company is pushing me to make a hasty decision and is threatening me with not paying for the car rental I needed to get (since my car cannot be driven as the tail light is broken and and rain would get in the car). Is there any way that the insurance company can be prevented from totaling my car and instead pay for properly fixing the car with good OEM parts instead of used (LKQ) parts. I got several estimates, two for around $5K and one for around $7K (this one is from an excellent body shop that has done excellent work on my other previous cars before). The insurance company provided and estimate for $4k using used/LKQ parts. I would appreciate any advice on how to get the best settlement from the insurance company.

I live in Logan, Utah and I was stopped at a red light when a car rear ended me going about 35 to 40 mph. I got whiplash and my neck, back and shoulder's have been hurting since. I also have headache's. The insurance company that will be paying for my injuries is allstate and they said they won't pay for excessive bills. How can I tell which bills they will count as reasonable and which bills aren't. I don't want to end up paying for anything, but I need to go see someone. I am going to make this simple as possible: During this year, Jan to March, I have been on my parent's insurance, NJ FamilyCare, which we were enrolled under free-care because we were horribly under the poverty line, or above it? We're poor, that's it. And on April 1st, I was terminated from my insurance, they are saying I am 19 years of age, thus I have no insurance. Late August we (as a family) re-applied with all our names, and sent the papers in. But with a lot of research, I knew I shouldn't have been, under the Affordable Care Act I should have been on my parent's insurance until the age of 26. I meet the requirements: 1. Dependent Adult (19 years old) 2. Full - time student, no college insurance. 3. No insurance for 6 months now. 4. Not employed. I know for a fact, that being a full-time student, and being unemployed, shouldn't affect this, but maybe it is? I talked to a representative from the welfare office, (where my parents applied) and the lady (rudely) told me that because I am 19, and in school, I was terminated. And my social worker won't be done looking at the papers until late November. WTF? That doesn't make sense, so I kept the battle on, and told her that I should be covered under the law. But after some bullsh*tting around, she hung up on me. So I called again. And this time, another lady was saying, her son who is 20 years old, is insured under her insurance, and that I should come in with my parents, and tell our social worker that I am a full time student, who can't afford to be employed, (because of my 21 credit semester), I am dependent, and I have no job. I was like, well, it's not like I don't want a job, I just can't find the time to have one. I used to work 12 hour shifts, so don't think I don't like to work. The main reason I need the insurance, is because of my ADHD and Mania. I also always get sick, and have kidney problems. But with this, I still can't imagine why I was terminated. The lady told me I shouldn't have been under the law, but different people have different ideas... So, I will go to my social worker on the Tuesday, and find out what's happening. But I know I should be covered, and at least for my sake until I am 23-24. To which I plan to graduate and get my own insurance, and home. But if it doesn't work out, what other low-payment options are there? I heard about NJ Protect, but it's expensive on my part, and no way can I burden my parents with out-of-pocket payments. I have heard that it may be better to get car insurance from a broker rather than online. I am 18, and I want to get my own policy. I am currently a named driver on my dads policy, as it is much cheaper to do it that way but I want to buy a car in my name and start earning my own ncb. I currently drive a Jaguar X Type and the insurance costs 2100 from Tesco (with my dad as the main driver). It would cost me about 3200 to insure it myself with Tesco.
